As we previously addressed, earlier this week the Wage and Hour Division of the U.S. Department of Labor (“DOL”) published answers to some key questions under the new paid leave provisions of the Families First Coronavirus Response Act. Today, the DOL updated its prior guidance to answer additional questions. Topics addressed by the updated guidance on the new paid leave provisions include recordkeeping and documentation requirements, when an employee is considered unable to work or telework so as to qualify for leave, the use of intermittent leave, the impact of workplace closures on leave entitlement, voluntary payments in excess of the statutory requirements, and supplementation of statutory paid leave with PTO. The first 14 questions and answers were issued by the DOL earlier this week; the remaining questions and answers include the new guidance issued today. With additional guidance to come, the situation continues to require monitoring.
